Attorney Joe Patituce Achieves Yet Another Client Victory
Attorney Patituce works hard to make sure justice is served—and it shows. He recently achieved great success on behalf of a client in a contentious jury trial, The State of Ohio vs. Anthony J. Bates (CR-17-613557-A).
The alleged victim accused Patituce’s client of ramming her head into a washing machine and fracturing her skull. The client faced charges of felonious assault, disruption of public service, domestic violence, and 10 years in prison. He was likely to be convicted based on the testimony of the alleged victim.
The client’s previous legal counsel wanted him to plead guilty and accept 5 years in prison. However, Patituce went in a different direction with the case supporting the client’s desire to be vindicated at trial.
Patituce successfully attacked the alleged victim’s accusation and on cross examination got her to agree that she could not say that Mr. Bates caused any of her injuries, in fact he demonstrated that most of her story was made up or false. Cross examination demonstrated that it was more likely she fell causing her injuries than anything as despite her claims of sobriety cross showed that her blood alcohol level was above 0.189% when she arrived at the hospital two hours later – meaning it was likely much higher at the time she fell. In addition to this, Patituce forced the detective to agree on cross examination that the detective had verified Mr. Bates’s version of events.
This case was tried in front of a jury of twelve people, however, the case never got there. The judge presiding over the State’s objection granted Patituce’s motion to dismiss after the State rested their case. This means that Patituce convinced the judge that no reasonable person could possibly find Bates guilty of this.
